Eviction Process

1. STEP ONE: SERVE TENANT WITH NOTICE

The type of notice depends on the reason for evicting the tenant:

  • 3-day for non-payment of rent (Do not include date of delivery, weekends or holidays)
  • 7-day for curable violations of the lease (Include weekends and holidays)
  • Notice of Termination for non-curable violations (Include weekends and holidays)
  • Notice of non-renewal for normal termination at end of lease

2. AUTHORIZATION TO BEGIN EVICTION PROCESS

Bring the following forms to your EVICTIONS PLUS, INC. meeting for signature:

  • Notice
  • Lease (if written)
  • Valid Photo ID for Notary

If you are out of the Tampa Bay area, we will e-mail you the documents to sign and have notarized. You may send these documents and supporting notices by courier to our office. Please be sure to retain a certified copy for your records.

3. STEP TWO: FILING THE LAWSUIT:

Evictions Plus, Inc. will then file all documents with the court in which the rental property is situated. The lawsuit is then turned over to a certified process server for that county.

4. SERVING THE LAWSUIT:

The process server will attempt to serve the tenant. (usually within 24 hours). If the tenant is not there or refuses to answer the door, the process server will leave and make a second attempt at least 6 hours later. If the tenant is there (or anyone living at the property that is over the age of 15 and is a permanent resident), the process server will serve the lawsuit. If there is nobody there, or they refuse to answer the door, the process server will "POST" the eviction on the door. "POSTING" allows you to obtain a judgment to remove the tenant, but not receive a judgment for any monies owed. We "POST" the eviction to speed up the removal process.

Once "served" the tenant must file a written response to the lawsuit within 5 business days from the date of the service. If the tenant interposes any other defense other than payment of the rent, the tenant is also required to put the rent that is due into the registry of the court or request a hearing for the judge to determine the amount of rent due.

5. STEP THREE: SECOND STEP (After filing):

After the five business days has expired, Evictions Plus, Inc. will take all necessary documents, including defaults and judgment for possession, to the court for filing. We provide all copies and postage paid envelopes required by the court.

6. JUDGMENT for POSSESSION:

After the judge has signed the judgment to remove the tenant, Evictions Plus, Inc. will call the client to ascertain if the tenant is still in the property or if they have vacated. If the client informs Evictions Plus, Inc. that the tenant has not vacated and requests us to pay the Sheriff to remove the tenant, we will have the Clerk of Court issue the Writ of Possession authorizing the Sheriff to remove the tenant. We then deliver the Writ of Possession to the Sheriff to process the final steps of the eviction.

7. STEP FOUR: SHERIFF'S PROCESS for WRIT OF POSSESSION:

The Sheriff will serve the tenant with a 24-hour notice requiring the tenant to vacate the property. The 24-hour time period does not begin until midnight on the date of service of the 24 hour notice.. As in the case of the 3-day notice, the time period does not include weekends or legal holidays either. The Sheriff's deputy will then notify Evictions Plus, Inc. as to what date and time we will be required to meet the deputy at the property to remove the tenant. This will be done WHEN the Sheriff schedules it. They are not always available immediately after the 24-hour notice. At that time we will take possession on behalf of our client. For additional fees, Evictions Plus, Inc. will remove all tenants personal belongings to the curb and change the locks.
